Terms of Service

These Terms of Service ("Terms") govern your access to and use of bookingagency.io and related services (the "Platform") operated by Tara Trade International LLC, a Wyoming limited liability company, doing business as The Booking Agency ("we", "us", "our").
By using the Platform, you agree to these Terms. If you do not agree, do not use the Platform.
1. Who We Are
Tara Trade International LLC operates bookingagency.io, a talent booking platform where independent professionals ("Talent") publish profiles and clients ("Clients") search for, contact, and book them. For bookings, the talent is the merchant of record. We facilitate the booking, generate the contract, and provide the platform on which they contract, without being a party to the underlying service agreement itself. Payment settles directly between Client and Talent.
Subscription billing for optional Premium and Pro features on the Platform is processed by Stripe Inc. on behalf of Tara Trade International LLC.
2. Eligibility
You must be at least 18 years old and legally able to enter binding contracts in your jurisdiction to use the Platform. If you represent a company, you warrant that you are authorized to bind that company to these Terms.
3. Accounts
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You agree to provide accurate information, keep it current, and not impersonate any other person or entity. We may suspend or terminate accounts that violate these Terms at our sole discretion.
4. Platform Role
Current stage of the Platform. Bookings are not yet open. Talent can publish and complete profiles, be listed and be found, and Clients can send inquiries. No booking can be confirmed through the Platform, no money moves through it, and no agency fee is charged to anyone. Stripe onboarding for Talent is closed while the booking and payment system is being built.
The rest of this section, and sections 5 and 7, describe how bookings will work and take effect only once that system is live. We will announce it before it applies, and Talent will be asked to accept the terms in force at that time rather than being bound by them automatically.
The Platform is a booking platform. The contract for the service booked is between Talent and Client; we are not a party to that agreement and do not perform, supply, or guarantee the quality of the service. We operate the platform, generate the booking contract, and set the terms of the engagement. The Talent sells directly to the Client and is the merchant of record. The Client pays the Talent's rate plus our agency fee to the Talent's payment account, and our fee is collected from that same transaction. We make no representations about the skills, availability, legal status, tax status, or quality of any Talent or Client on the Platform.
5. Fees and payments
Talent set their own rate. The Client pays that rate plus an agency fee of 25% on top of it.
The Talent pays no fee to The Booking Agency, and The Booking Agency deducts nothing from the Talent's payment. Stripe deducts its own payment processing fee from the Talent's payout. That fee is calculated on the full amount the Client pays, which includes the agency fee, so it is larger than a fee calculated on the Talent's rate alone. The Booking Agency does not set that fee, does not receive it, and does not state a rate for it: it varies by card and by country.
The agency fee applies only to the fee-bearing part of a booking: the performance itself and the preparation time agreed with it. It is never charged on expenses. Travel, accommodation, meals and local transport pass through at cost, with no fee and no margin added to them.
VAT is added on the agency fee where applicable. The rate depends on the Client's country and on whether the Client is a business or a consumer. Business clients in the European Union with a valid VAT number are invoiced under the reverse charge mechanism, and the Client is responsible for the accuracy of the VAT number provided.
Payments are processed by Stripe. The Client's payment settles directly on the Talent's Stripe account. The Booking Agency does not hold, control or transmit Client funds at any point, operates no escrow and no client account, and does not run payouts. The agency fee is collected from that same payment.
Stripe's processing fee is deducted from the Talent's payment by Stripe. The Booking Agency does not set that fee and does not receive it.
A booking becomes binding only once payment has been received. Work does not begin before that point.
The Talent invoices the Client for their rate and is responsible for their own VAT. The Booking Agency invoices the Client for the agency fee and the VAT on it. Both may appear on a single document. On that document the line is called agency fee.
Contact details for the other party are shared only after a booking is confirmed.
6. Independent Talent, Our Role, Taxes and Insurance
(a) Independent talent. Talent listed on The Booking Agency ("TBA") are independent providers. They are not employees, workers, or agents of TBA, and TBA is not their employer or principal. Talent set their own availability, choose which bookings to accept, and control how they deliver their services.
(b) TBA operates the booking platform. When a client books talent through TBA, the contract for the services is between the client and the talent. TBA operates the platform and administers the booking: we introduce the parties, generate the contract, and apply the cancellation and refund policy. Payment runs directly between Client and Talent, and our fee is taken from that transaction. TBA is not a party to the underlying services contract and is not responsible for the performance, quality, or outcome of the talent's work.
(c) Payment. The Client pays the Talent's rate plus the agency fee and any VAT on that fee. Payment is made through Stripe directly to the Talent's own Stripe account. The Booking Agency does not receive, hold or forward the money, and does not operate an escrow. The agency fee is collected from that same payment and is charged to the Client; Stripe's payment processing fees are deducted from the Talent's payment by Stripe. Expenses agreed with the booking pass through at cost and carry no fee.
(d) Talent responsibilities (confirmed at onboarding). Each talent confirms, at onboarding, that: (a) they are legally entitled to perform the work, including in the location where it takes place; (b) they are responsible for their own income tax, VAT, and social contributions on what they earn; and (c) they carry their own insurance where needed, and understand that TBA provides none. These are self-declarations. TBA does not verify right to work, tax status, or insurance, and does not check or hold supporting documents.
(e) No insurance from TBA. TBA provides no insurance of any kind in connection with bookings or with the talent's services. Any insurance is the talent's own responsibility.
(f) Client acknowledgment. When booking, the client acknowledges that they are engaging independent talent and that TBA operates the platform, not as the employer or principal of the talent.
(g) Our own tax reporting. TBA's own tax and platform-operator reporting obligations (including any reporting such as DAC7) are separate from, and do not affect, the talent's personal tax responsibilities set out above.
7. Cancellation and refunds
The agency fee follows the rate proportionally: whatever share of the rate the Talent is entitled to under the bands below, the same share of the agency fee is retained, and the remainder of the fee is refunded to the Client with the rest of the refund.
If the Client cancels more than 14 days before the booking, the Talent receives nothing and the Client is refunded in full, including the agency fee.
Between 14 days and 48 hours before, the Talent receives 50% of the rate. 50% of the agency fee is retained; the balance of the rate and of the fee is refunded to the Client.
Within 48 hours of the booking, the Talent receives the rate in full and the agency fee is retained in full. There is no refund.
If the Client cancels after the booked date has passed, the rate is split 50/50 between Client and Talent, and 50% of the agency fee is retained.
If the Talent cancels at any point, or the Platform causes the cancellation, the Client is refunded everything, including the agency fee in full. A Talent cancellation is recorded against the Talent's account. Three such cancellations within a rolling 12 months make a Talent unbookable until reviewed.
Expenses the Talent has already incurred and cannot recover - a non-refundable flight, accommodation already paid for - are reimbursed in full regardless of which cancellation band applies, on production of evidence. Expenses not yet incurred, or which the Talent can still recover, are refunded to the Client in full.
Where VAT has been charged on the agency fee, any refund of that fee includes the corresponding VAT.
8. What you're seeing on The Booking Agency
Talent listings. Talent on The Booking Agency are independent professionals who subscribe to be listed in our directory and set their own rates. The Booking Agency does not employ any listed talent. When a Client books a Talent through the Platform, the service agreement is between Client and Talent; The Booking Agency operates the platform on which they contract, as described above.
Job and gig listings. Job and gig listings displayed on bookingagency.io are aggregated from publicly available sources including company career pages, public job boards, and recruiting platforms (Workable, Greenhouse, Lever, Ashby, Backstage, WeWorkRemotely, Himalayas, and similar). Each listing displays its source ("via {source}") and the Apply button redirects to the original poster. The Booking Agency is not the employer or agent of record for any aggregated listing, does not collect applications, and does not control hiring decisions made by the listing source.
9. Ranking
Talent profiles and search results are ordered by system rules. Profiles are first placed into groups according to whether the talent can currently accept a booking, whether payouts are available in their country, and whether their account is subject to a restriction. Within a group the main parameters are whether we have reviewed the profile, whether it has a photograph, how complete it is, how much interest it has attracted, and subscription tier. Paid subscription influences ranking: paid subscribers receive a visibility boost. These parameters and the reasons for them are described in section 11 of our Privacy Policy, which is the authoritative version and is updated when they change.
10. User Content
You retain ownership of content you submit to the Platform (including profile text, photos, portfolio items, and messages). You grant us a worldwide, non-exclusive, royalty-free license to host, display, distribute, and promote your content in connection with operating the Platform and marketing it. You represent that your content does not infringe third-party rights and that you have permission to upload any personal data it contains.
11. Acceptable Use
You agree not to: (a) use the Platform for unlawful purposes; (b) publish false, defamatory, discriminatory, or harassing content; (c) scrape, copy, or republish other users data outside of direct personal use; (d) attempt to access accounts or data you do not own; (e) interfere with the Platform infrastructure; (f) use the Platform to solicit services in violation of applicable law (including unlicensed professions).
12. Subscriptions
Certain Platform features require a paid subscription. Prices are displayed on bookingagency.io. Subscriptions renew automatically at the end of each billing period (monthly or annually) until cancelled by you through your account dashboard. You authorize us (via Stripe) to charge your payment method for renewals at the then-current price. See the Payment Terms and Refunds and Disputes Policy for details.
13. Intellectual Property
The Platform code, user interface, design, brand assets, logo, and original editorial content are owned by Tara Trade International LLC and protected by intellectual property law. You may not copy, modify, redistribute, or create derivative works of these Platform-owned materials without our prior written consent.
Certain data displayed on the Platform is sourced from open-data providers and is made available to you under those providers' own licenses, including: OpenStreetMap (Open Database License, ODbL), GeoNames (CC BY 4.0), and Wikidata (CC0). We do not claim ownership of underlying open data and we attribute these sources as required by their licenses.
14. Third-Party Services
The Platform includes links to third-party services (Stripe for payments, Google Analytics, Travelpayouts affiliate links, OpenStreetMap venue data, and others). Your use of those services is governed by their own terms and privacy policies. We are not responsible for third-party services.
15. Disclaimers
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT CONTENT IS ACCURATE OR RELIABLE. WE DO NOT WARRANT THE QUALITY, SAFETY, LEGALITY, OR TIMELINESS OF ANY SERVICE PERFORMED BY TALENT.
16. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TARA TRADE INTERNATIONAL LLC AND ITS AFFILIATES, OFFICERS, MEMBERS, AGENTS, AND EMPLOYEES ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS IS LIMITED TO THE AMOUNT YOU PAID US IN THE TWELVE MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED U.S. DOLLARS, WHICHEVER IS GREATER.
17. Indemnification
You agree to indemnify, defend, and hold harmless Tara Trade International LLC and its affiliates from any claims, damages, liabilities, and expenses (including reasonable attorneys fees) arising from your use of the Platform, your content, or your breach of these Terms.
18. Termination
We may suspend or terminate your access to the Platform at any time, with or without cause, with or without notice. You may terminate your account at any time through the account dashboard or by emailing [email protected]. Sections that by their nature should survive termination will survive.
19. Governing Law
These Terms are governed by the laws of the State of Wyoming, USA, without regard to conflict of laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
20. Dispute Resolution
Any dispute, claim, or controversy arising out of or relating to these Terms or the Platform shall be resolved by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. Arbitration shall take place in Cheyenne, Wyoming, or another location mutually agreed. Each party shall bear its own costs. Judgment on the award rendered may be entered in any court of competent jurisdiction. To the extent arbitration is unavailable or unenforceable, the parties consent to the exclusive jurisdiction of the state and federal courts located in Wyoming. You and we each waive any right to a jury trial and any right to participate in a class action.
21. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated at least 30 days in advance by email to the address on file and by notice on the Platform. Continued use of the Platform after the effective date of changes constitutes acceptance.
22. Miscellaneous
These Terms constitute the entire agreement between you and Tara Trade International LLC regarding the Platform and supersede any prior agreements. If any provision is held unenforceable, the remaining provisions remain in full effect. We may assign these Terms; you may not assign them without our consent. No waiver of any provision is a waiver of that or any other provision on another occasion.
23. Our Use of AI
We build and run this platform with the help of AI tools, and we would rather tell you where than let you guess.
Written by AI, reviewed by us. City guides, category descriptions, area introductions and some blog articles are drafted with AI and edited before publication. Where a page describes a place, a category or a typical rate, treat it as a starting point rather than a final authority.
Suggested by AI, confirmed by a person. We suggest categories for a talent profile based on what that talent has written about themselves. Nothing appears on a public profile until the talent confirms it, and a talent can remove or change any category we suggest. Once they do, our systems will not overrule that choice.
Never AI. Talent profiles, photographs, portfolios and reviews are real. We do not generate a person, a face, a portfolio piece or a review, and we do not alter a talent's own words to make them sound like someone else.
No automated decisions with legal effect. We do not make automated decisions that produce legal effects or similarly significant effects on a person, and we do not use AI to decide who may join the Platform or who gets paid. Booking eligibility and search ordering are determined by system rules, described in our Privacy Policy.
Your data. We do not sell your data to train anyone's AI model.

25. Service Provider, Jurisdiction & Compliance
The Service is provided by Tara Trade Intl LLC, a Wyoming, USA limited liability company ("Tara Trade"). All payments, subscriptions, contracts, and contractual obligations under these Terms are formed between you and Tara Trade.
Governing Law and Venue. These Terms are governed exclusively by the laws of the State of Wyoming, USA, without regard to conflict of law principles. The parties consent to the exclusive jurisdiction of state and federal courts located in Wyoming for any dispute arising from these Terms.
Tax and Compliance. Talent are responsible for compliance with their own local tax laws and any required reporting of payments received. Client payments reach Talent through US-based payment processors (Stripe, Inc., including Stripe Connect).
Service Model. Tara Trade operates a booking platform: it generates the contract between Talent and Client, applies the published cancellation and refund policy, and is not a party to the underlying service agreement. Tara Trade does not employ Talent, and is not the employer or agent of record for aggregated job and gig listings.
26. Job and Gig Feed Syndication
The public job and gig RSS feeds at bookingagency.io/jobs.rss and bookingagency.io/gigs.rss are provided for personal, non-commercial review and for linking back to the original listing on bookingagency.io. Any reuse or republication of feed content, in whole or in part, must attribute The Booking Agency and include a visible link back to the canonical listing URL on bookingagency.io. That attribution and link back may not be removed, obscured, or altered. Bulk extraction, scraping, or automated republication of the feed beyond normal periodic fetching is not permitted. Rights to the underlying content of each listing remain with its original poster; the feed grants linked, attributed display only, not republication rights.
